The imposition of a prohibition order can severely impact upon the owner’s ability to market their product. The Registrar’s decision to impose a prohibition order is subject to review by the Administrative Appeals Tribunal [s 136(1)(f) of the Designs Act 2003 (Cth)]. In such an event the Registrar will take steps to ensure the AAT applies confidentiality procedures appropriate to the nature of the material being considered.
