19.4. Priority date: Plural designs

When a design application discloses more than one design, the designs may have different priority dates.

An example of this is where the application claims convention priority from more than one basic application, and those basic applications were filed on different dates. In this situation, each of the different designs may be registered with a different priority date.

  • If the different designs are registered, each design may have a different date in the Register
  • If the designs are excluded from the original application under s 23, the new application will carry the priority date that each design had in the original application into the new application. This also applies to excluded designs as part of transitional applications. See s 160(3) and reg 12.03(3).
