22.6.5. Other types of amendments: Register indicating that a design has been revoked

If the Registrar decides to revoke a registration they must make an entry in the register to this effect (s 115).​​​​​​​

The entry indicates that the registered design has been revoked and that the design is taken to never have been registered.

Circumstances which may lead to the registered design being revoked include:

  • The Registrar receives an offer from the registered owner of a design to surrender the registration (s 49 and s 50).
  • The Registrar revokes the design on the basis of an ownership dispute (s 51 and s 52).
  • The Registrar has examined the registered design and is satisfied that a ground for revocation has been made out (s 68) which cannot be removed by a s 66 request.
  • ​​​​​​​A court makes an order revoking the registration of a design.
