46.1. What is opposition to registration or protection?

Opposition is a formal objection by a third party to registration of a trade mark or to protection of an International Trade Mark Designating Australia (IRDA). Any person may oppose but the opponent is generally a person who will be in some way affected by the presence of the trade mark on the Register. The opposition process enables such a person  to make out a case under the grounds specified in the Act and Regulations that the trade mark should not be registered or protected.
