4.22.2  General Description

An international registration lasts for 10 years from the date it was filed in the Office of origin. International registrations can be renewed indefinitely on payment of the appropriate fees to the IB every 10 years.

Where Australia has been designated in an international registration, the IB will notify IP Australia when the relevant international registration has or has not been renewed. If it is renewed IP Australia will receive an individual renewal fee from the IB.

An international registration may be due for renewal less than ten years after Australia has been designated. This will occur where Australia has been subsequently designated (see 1.6 Subsequent Designations).

If an international registration is not renewed, the IB will notify IP Australia, and protection will cease. The Protocol allows renewal to occur within a period of 6 months after the due date.

 

4.22.3  When an International Registration Is Renewed:

  • The IB informs IP Australia that an international registration has been renewed and advises IP Australia of the new expiry date.
  • The renewal of the international registration is published.

 

4.22.4  When an International Registration Is Not Renewed:

  • The IB informs IP Australia that an international registration has not been renewed within the 6 months period of grace allowed under the Madrid Protocol.
  • IP Australia changes the status on the Trade Marks Office database to ‘IR not renewed’
  • The cessation of protection is published in Australian Trade Mark Search.
