3.6. Fees: Fees for extensions of time

Date Published 05 Jun 2024

Most fees for extensions of time are based on a monthly rate.

If the reason for the extension is an error or omission by the Designs Office (s 137(1)) there is no fee.
If the reason for the extension is an error or omission by the applicant or their agent (s 137(2)(a)), the fee per month applies.
If the reason for the extension is circumstances beyond the applicant's control (s 137(2)(b)), there is a single total fee (not a fee per month).

If the extension relates to an application for more than one design, the extension fee covers all the designs.

If the extension is for a common design application, the extension fee covers all the products that have the common design.
