2.1

Section 163(1) of the Act provides that except for Part 10 of the Act (Assignment and Transmission of Trade Marks), a collective trade mark is to be considered in the equivalent manner to an ordinary trade mark. A reference in the Act to a trade mark registered by a person is taken to include a reference to a trade mark registered by an association.

Under section 163(2) use by any one or more members of the association is use for the purposes of the Act.
