There are a number of circumstances where a registered owner might want to cancel the registration. The owner may cancel:

  • where the trade mark has been cited against an application for registration of another trade mark;
  • if the owner no longer has an interest in the trade mark; or
  • to avoid the expense of a non-use or rectification action.
