The applicant must file a request for examination before examination of an application can commence (sec 44). Before commencing examination, examiners must check that a request for examination is on file, and if not, COG must be notified.

Attorneys will occasionally advise, after examination has been requested, that they have been instructed to take no further action in regard to a particular application. This advice does not amount to a withdrawal. Where such advice has been received, examiners should follow the procedures outlined in Stated Disinterest in Proceeding with the Application.
