Acknowledgement of prior art in a patent specification is an admission which carries great weight (Bristol-Myers Squibb Co v F H Faulding and Co Ltd 46 IPR 553 and referred to in What is Common General Knowledge?). However, this does not prevent the applicant or patentee from providing evidence to contradict it (Gerber Garment Technology v Lectra Systems [1995] FSR 492).
