Plant Breeder’s Rights Act 1994:

  • s8 Approved persons 

A qualified person (QP) is referred to as an approved person under section 8 of the Act.

 

The QP is responsible for:

  • verifying the particulars of the application;

  • supervising any required test growing;

  • preparing or verifying the detailed description of the variety.

     

The applicant must nominate a QP in the Part 1 application before the application can be accepted.
 

A QP may only perform these functions after the applicant or their agent has nominated the QP.


A QP may also act as the applicant's agent if appointed to do so.

  • The applicant may change the nominated QP after filing by following the relevant change of Qualified Person process. For information about QP accreditation, eligibility and administration, see 4.2.4 Qualified Person and 8. Qualified Persons (QPs).
