6.1 PBR Search
Overview
The IP Australia website hosts a PBR search tool available to internal staff and external stakeholders. Applicants are encouraged to confirm if their variety is new to the Australian market by checking PBR Search.
PBR Search coverage
The database covered by PBR Search includes details of existing varieties (as documented in the Plant Varieties Journal and the PBR Register) for which an application for PBR has been filed and the application is:
accepted;
granted;
terminated;
expired;
refused;
rejected; or
withdrawn.
PBR Search will not display details of any pending applications.
PBR Search users can use either the Quick Search (to initially sort by genus or species) or Advanced Search (to apply additional fields and further narrow the search). Further details and guidance material on the use of PBR Search can be viewed at 10.3 PBR Search.
Searching outside of Australia
Where applicants intend to sell their variety internationally or believe the variety may be registered in another country, they should conduct an international search of the PLUTO Plant Variety Database. The PLUTO database contains information relating to plant varieties registered in International Union for the Protection of New Varieties of Plants (UPOV) member countries. The PLUTO database is maintained by UPOV and includes records submitted by UPOV member countries.
If applicants wish to search plant varieties registered in a country not included in the PLUTO database, they should contact the country’s office directly for access to their records.
