12.3. Section 43 refusal to register: Anzac

Any design that includes the word ‘Anzac’ or any word that resembles ‘Anzac’ among its visual features must not be registered, regardless of the product bearing the design (see the Protection of Word ‘Anzac’ Regulations 1921, reg 2(4) made under the War Precautions Act Repeal Act 1920 (Cth)).

The only exception to this rule is when the applicant proves that they have permission from the Minister for Veterans’ Affairs to use this word (Protection of Word ‘Anzac’ Regulations 1921, reg 2(1)).
