3.6. Fees: Fees for extensions of time
Date Published
Most fees for extensions of time are based on a monthly rate.
- If the reason for the extension is an error or omission by the Designs Office (s 137(1)) there is no fee.
- If the reason for the extension is an error or omission by the applicant or their agent (s 137(2)(a)), the fee per month applies.
- If the reason for the extension is circumstances beyond the applicant's control (s 137(2)(b)), there is a single total fee (not a fee per month).
If the extension relates to an application for more than one design, the extension fee covers all the designs.
If the extension is for a common design application, the extension fee covers all the products that have the common design.
