22.6.4. Other types of amendments: Change of name or address

Where there is a change in the name or address of the owner, the Register is amended under reg 9.05(2)(b).

​​​​​​​​​​​​​​These amendments do not change the identity of the owner or transfer any ownership, so the Registrar would not normally notify persons entered on the Register as having an interest and would not advertise the amendment for opposition purposes. However, any changes in ownership must be dealt with as an assignment under s 114.

Where it is not clear whether the request relates to an assignment or a name change, the Customer Experience Group, which handles this type of request, will ask for further information/evidence on the particular circumstances. Typically, this situation arises in relation to mergers. See ‘Mergers’ in Assignment: Possible complications for more information.
