2.3. Application for registration: Minimum filing requirements

Date Published

The minimum filing requirements (MFRs) are the minimum information requirements that must be met for a design application to receive a filing date.

If the MFRs are met:

  • The application is assigned a filing date

  • The applicant is sent a filing notice

  • Each design is allocated a design number

  • Certain application information is published on Australian Design Search.

Filing date

The filing date is the day on which the application meets the MFRs, see s 26. The filing date will ordinarily be the priority date unless another priority date applies. For example, when a valid convention priority claim is made. See s 27.

Most application information is not made publicly available until the design is registered.

If an application does not meet the MFRs, a written notice will be issued and will provide a period in which to correct the deficiencies. If a response is not received within that period, the application is taken not to have been filed. Any filing fee paid will be refunded. A notification is also provided where an application meets MFRs. See s 24.

What are the minimum filing requirements?

These are outlined at s 21 and reg 3.01.

The application must indicate that registration of a design is sought

This requirement may be met, for example, by:

  • using a form headed Application for a design

  • including a statement such as ‘I apply for registration of a design’

  • providing a letter that clearly indicates an intention to apply for registration of the design.

The application must include a representation of each design

The application must contain a representation, or information that appears to be a representation, of each design for which registration is sought.

The application must identify the applicant

The application must contain sufficient information to establish the applicant’s identity, including the applicant’s name.

The applicant must be a legal person capable of holding the rights associated with a registered design. See Applicant details and specifically, Is the applicant a ‘person’?

The application must include contact information

The application must include sufficient information to enable correspondence about the application to be sent to – and received by – the applicant or their agent, including:

  • A valid address for the applicant

  • An address for service that satisfies the applicable legislative requirements

  • A telephone number for the address for service, where possible.

The application may also include:

  • the name of a representative or agent

  • an address for correspondence

  • another telephone number

  • an email address.

See Applicant address.
