2.4. Application for registration: Who is entitled to be the registered owner

Date Published

Section 13 provides five circumstances in which a person may be entitled to be entered on the Register as the registered owner of a design:

  1. The person created the design and is the designer.

  2. The person derives title from a person who created the design under a contract with them.

  3. The person is the employer of the designer and the design was created in the course of employment or under a contract of service.

  4. The person derives title from an entitled person by assignment, devolution by will or operation of law.

  5. The person is the legal personal representative of a deceased person who was entitled to the design.

Applicant is the designer

Subject to any agreement or other circumstance affecting entitlement, the designer is entitled to the design.

Design created under a contract

A person may be entitled where they derive title from a designer who created the design under a contract with them. Whether title has been transferred will depend on the terms and legal effect of the contract.

Design created in the course of employment

If an employee creates a design in the course of their employment or under a contract of service, the employer is generally entitled to the design unless an agreement provides otherwise.

Assignment, devolution or operation of law

An entitled person may transfer all or part of their interest in a design by assignment. An assignment must be in writing and signed by, or on behalf of, both the assignor and the assignee.

Entitlement may also pass by devolution under a will or by operation of law. See Assignments and other interests for further information.

Legal personal representative of a deceased person

A legal personal representative may be entitled to be the registered owner where the deceased person was entitled to the design. Documentary evidence would ordinarily be required to establish the representative’s authority and the relevant chain of entitlement.

Where entitlement is not apparent on the information available, clarification, information or evidence may be requested.
