Division 3 of Part 4 of the Act sets out a process whereby a trade mark applicant may file an application (divisional application) as a limited continuation of their current application (parent application) under certain circumstances. Divisional applications claim the priority date of the original parent application, however, they receive a new trade mark number and must meet the conditions specified in sections 45 and 46 of the Act.
