40.3. Late renewal

3.1 A trade mark may still be renewed up to six months after its date of expiry, (section 79) subject to the payment of the renewal fee and any late fees.  Late fees are calculated for each month after the expiry date for renewal and subject to the request being in an approved form (section 75). Besides the late fees, there are no other special requirements for late renewal.

3.2 Late renewal still renews the registration for a period of ten years from the date of expiry.
