3.1

Applications for registration of collective trade marks will, in the main, be dealt with in the same way as applications for ordinary trade marks as collective trade marks are subject to virtually the same registrability criteria as ordinary trade mark applications.

 

3.2

The application must be made in the name of the association. If the application is not made in the name of an association (for e.g. the application is made in the name of an individual) the ownership should be queried and an explanation given that only the association itself can be treated as the applicant or owner of a collective trade mark.
